Trademarking
We handle applications for Trademarks. The process is usually simple and relatively inexpensive.
Registering your trademark is not essential however, so we offer advice on the pros and cons – such as the likelihood of your trademark’s acceptance for registration based on its uniqueness of name and appearance, or by predicting the effect on your brand in an infringement scenario.
Here are some interesting facts about the common marks we use in branding:
TM
Anyone can put the TM (trade mark) symbol by their logo because TM has no legal status. It does not mean it is a registered trademark. It only indicates that you claim it is yours.
®
The ® (registered) symbol can be used next to your registered trademark. This has some legal standing. It means your mark has been accepted as being unique by a government office. So the ® is an important symbol to ward off imitation.
©
Anyone can use the © symbol to remind people that original content is yours and that it cannot be copied. Actually, whenever you create original work of your own accord you automatically have natural copyright of it by law – fantastic! However, there are various shades of ownership depending on the circumstances.
